Government faces 'legal difficulties' on eviction bans and rent holidays, warns attorney-general – The Times

The attorney-general has warned government of “significant legal difficulties” if it tries to stop business evictions or force landlords to give rent holidays to commercial tenants unable to trade because of the coronavirus lockdown.

Business minister Heather Humphreys asked attorney-general Séamus Woulfe to investigate the legality of measures such as eviction bans and rent moratoriums to help thousands of businesses unable to pay their rents after being ordered to close to help contain the Covid-19 pandemic.

“I have just received a response in which the attorney-general advises that there are significant legal difficulties in respect of both of the questions posed,” she said in reply to a Dail question. “The difficulties stem from a variety of legal bases including statutory, constitutional, contract and common law.
